If you’ve spent any time researching home care agencies, you’ve seen the phrase: licensed, bonded, and insured. Every reputable agency says it. But do you know what it actually means — and more importantly, what happens to your family if the agency you choose isn’t one of these things?
Licensed
In California, home care agencies are regulated by the California Department of Social Services under the Home Care Services Consumer protection Act. A licensed agency has completed a formal registration and approval process, meets state standards for operations, and is subject to oversight and complaint investigation.
What this means for your family: there’s accountability. If something goes wrong, there’s a regulatory body you can contact. An unlicensed agency operates without this framework. That doesn’t mean every unlicensed arrangement is problematic, but it does mean there’s no oversight structure protecting your family.
Bonded
A surety bond is a form of financial protection against theft or dishonesty by a caregiver. If a bonded agency’s caregiver steals from your parent, the bond provides a mechanism for financial recovery.
Consider what’s in your parent’s home: valuables, cash, prescription medications, financial documents, personal items of sentimental worth. A bond doesn’t prevent theft, but it means there’s a financial backstop if it occurs.
Insured
The most important of the three for many families. A properly insured agency carries:
General liability insurance: Covers property damage or injury that occurs in the course of caregiving.
Workers’ compensation insurance: This is the one families often don’t think about. If a caregiver is injured in your parent’s home — a back injury from a transfer, a slip on a wet floor — workers’ compensation covers their medical treatment and lost wages. Without it, the injured caregiver may be able to bring a claim directly against your family.
Families who hire independent caregivers directly are often unknowingly assuming this liability.
The practical Question to Ask
When speaking with any home care agency, ask directly: “Can you provide documentation of your CDSS home care license number, your bond, and your liability and workers’ compensation insurance certificates?”
